These Terms of Use explain how you may use Domaxus and the important limits of our educational seller tools. Domaxus is not a broker, appraiser, attorney, lender, or financial advisor. Please read carefully. By using Domaxus, you agree to these Terms. Questions? Email info@domaxus.com.

1. Agreement to These Terms

These Terms of Use (“Terms”) are a binding agreement between you and Domaxus (“Domaxus,” “we,” “us,” or “our”) governing your access to and use of the Domaxus website, seller workspace, questionnaires, estimates, recommendations, calculators, learning content, and related services (collectively, the “Services”).

By visiting Domaxus, creating an account, submitting property information, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.

2. What Domaxus Is (and Is Not)

Domaxus is a seller-first real estate intelligence platform. We help homeowners explore practical selling paths—such as an MLS / realtor path, an investor cash path, or a builder / redevelopment path—using information you provide, third-party property and address data, repair-estimate models, comparable-sale analysis, and path-recommendation logic.

  • Domaxus provides educational decision-support tools, estimates, and explanations.
  • Domaxus is not a real estate brokerage and does not list, market, or sell your property for you.
  • Domaxus is not an appraisal firm and does not provide formal appraisals, broker price opinions, or guaranteed valuations.
  • Domaxus is not a law firm, accounting firm, tax advisor, mortgage lender, title company, or inspector.
  • Domaxus does not create a fiduciary, agency, or professional-client relationship with you.
  • Future marketplace links, partner introductions, and paid tools may be offered later as placeholders or optional features; unless and until those features are live and expressly described, they are not part of the Services you can rely on today.

3. Eligibility and Accounts

You must be at least 18 years old (or the age of majority where you live, if higher) and able to form a binding contract to use the Services. The Services are intended for adults evaluating residential real estate selling decisions.

A. Account registration

Some features require an account. You agree to provide accurate information and to keep it updated. You are responsible for your login credentials and for all activity under your account. Notify us promptly at info@domaxus.com if you suspect unauthorized access.

B. One person, one account

You may not share accounts, create accounts for others without permission, or use another person’s account without authorization. We may suspend or terminate accounts that appear fraudulent, abusive, or insecure.

4. Your Responsibilities

When you use Domaxus, you agree that:

  • You own, control, or are authorized to evaluate the property information you submit.
  • You will provide information that is accurate and complete to the best of your knowledge.
  • You understand that incorrect or incomplete inputs can produce misleading estimates and recommendations.
  • You will use the Services only for lawful purposes and in accordance with these Terms.
  • You will not rely on Domaxus outputs as a substitute for professional advice or independent due diligence.
  • Before making selling, contracting, financing, remodeling, or legal decisions, you will consult qualified local professionals (such as a licensed realtor, attorney, title company, tax advisor, inspector, lender, or contractor, as appropriate).

5. Educational Estimates, Recommendations, and Calculators

This section is central to how Domaxus works and how risk is allocated between us.

A. Nature of outputs

Repair estimates, comparable analyses, valuations, path scores, take-home calculators, amortization illustrations, learning content, and seller-path recommendations are educational models and decision-support tools. They are based on assumptions, rules engines, available data, and the information you provide.

  • Outputs are approximate and may be incomplete, outdated, or incorrect.
  • Outputs are not a promise of sale price, net proceeds, timeline, buyer interest, repair cost, financing approval, or transaction outcome.
  • Market conditions, property condition, title issues, occupancy, financing, and negotiation can change results materially.

B. Third-party data

We may use third-party providers for address validation/autocomplete (for example, Smarty), property and comparable-sales data (for example, RentCast), authentication, hosting, payments, email, and monitoring. Third-party data may be delayed, incomplete, or inaccurate. Domaxus is not responsible for third-party data quality beyond commercially reasonable integration efforts.

C. No professional advice

Nothing on Domaxus is legal, tax, accounting, brokerage, appraisal, lending, insurance, engineering, or investment advice. Educational content about seller financing, equity partnering, short sales, novation-style concepts, or similar topics is general information only and may not apply to your situation or jurisdiction.

D. Your decisions

You alone decide whether and how to sell, whom to hire, what contracts to sign, and what risks to accept. Domaxus does not make those decisions for you and is not liable for outcomes of your real estate or financial decisions.

6. License to Use the Services

Subject to these Terms, Domaxus grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal, non-commercial evaluation of selling options for properties you are authorized to evaluate.

We (and our licensors) retain all right, title, and interest in the Services, including software, models, designs, trademarks, logos, text, graphics, and ranking/recommendation logic. Except for the limited license above, no rights are granted by implication or otherwise.

7. Acceptable Use

You agree not to:

  • Scrape, harvest, crawl, or systematically extract data from the Services without our prior written consent.
  • Reverse engineer, decompile, or attempt to derive source code or model weights/rules except where applicable law prohibits this restriction.
  • Interfere with or disrupt the Services, security controls, or other users’ access.
  • Upload malware, attempt unauthorized access, or probe vulnerabilities except through authorized security research channels we expressly permit.
  • Misrepresent your identity, property ownership, or authority.
  • Use the Services to harass, defraud, or harm others, or to violate any law or third-party rights.
  • Use automated means to create accounts or submit content in a way that burdens or manipulates the Services.
  • Resell, white-label, or commercially redistribute Domaxus outputs as a competing product without our written permission.
  • Remove proprietary notices or use Domaxus branding in a misleading way.

8. Your Content and Feedback

You retain ownership of information you submit (such as property details, questionnaire answers, and support messages) (“User Content”). You grant Domaxus a worldwide, non-exclusive, royalty-free license to host, store, process, display, and use User Content as needed to operate, secure, improve, and provide the Services, and as described in our Privacy Policy.

You represent that you have the rights to submit User Content and that doing so does not violate law or third-party rights.

If you send feedback, ideas, or suggestions, you grant Domaxus a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation, to the extent permitted by law.

9. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Services, you acknowledge that Privacy Policy. If there is a conflict between these Terms and the Privacy Policy on a privacy disclosure topic, the Privacy Policy controls for that topic; these Terms control for contractual use of the Services.

10. Fees, Trials, and Billing (If Applicable)

Some Domaxus features may be free; others may require payment in the future. If paid features are offered:

  • Prices, billing intervals, and what’s included will be shown at checkout or in-product.
  • Payments may be processed by third-party processors (for example, Stripe). Their terms may also apply.
  • Unless required by law or stated otherwise at purchase, fees are non-refundable once charged.
  • You authorize us (and our processor) to charge your payment method for applicable fees and taxes.
  • We may change pricing with notice as required by law; continued use after the change effective date may constitute acceptance.
  • Failure to pay may result in suspension or termination of paid features.

11. Third-Party Services and Links

The Services may link to or integrate third-party websites, tools, data providers, authentication providers, payment processors, or future partner CTAs. We do not control third parties and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

Placeholder CTAs for realtors, investors, builders, contractors, or education partners do not constitute an endorsement, referral agreement, or guarantee of availability, pricing, or quality.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT, ESTIMATES, RECOMMENDATIONS, CALCULATORS, DATA, AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY ESTIMATE OR RECOMMENDATION WILL MEET YOUR EXPECTATIONS OR MATCH ACTUAL MARKET, REPAIR, OR TRANSACTION RESULTS.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS. IN THOSE PLACES, DISCLAIMERS APPLY TO THE FULLEST EXTENT PERMITTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOMAXUS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR COST OF SUBSTITUTE SERVICES—WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE—ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, DOMAXUS IS NOT LIABLE FOR REAL ESTATE TRANSACTION OUTCOMES, MISSED MARKET OPPORTUNITIES, RELIANCE ON ESTIMATES OR PATH RECOMMENDATIONS, THIRD-PARTY DATA ERRORS, OR DECISIONS YOU MAKE AFTER USING THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO DOMAXUS FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

THESE LIMITATIONS ARE A FUNDAMENTAL PART OF THE BARGAIN AND APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS RESTRICT LIABILITY LIMITATIONS; IN THOSE PLACES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT ALLOWED.

14. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Domaxus and its owners, officers, employees, contractors, affiliates, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your use of the Services; (c) your real estate, contracting, or financial decisions; (d) your violation of these Terms or law; or (e) your infringement of third-party rights.

15. Suspension and Termination

You may stop using the Services at any time and may request account closure by contacting info@domaxus.com.

We may suspend or terminate access to the Services (in whole or part) at any time if we believe you violated these Terms, create risk or legal exposure, fail to pay fees when due, or if we discontinue the Services. We may also modify or discontinue features with or without notice, subject to applicable law.

Sections that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnification, dispute terms, and miscellaneous provisions) will survive termination.

16. Changes to the Services or Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date and, where required, provide additional notice. Continued use after changes become effective constitutes acceptance of the updated Terms, except where applicable law requires a different process. If you do not agree, stop using the Services.

17. Disputes, Governing Law, and Venue

These Terms are governed by the laws of the State of Texas, excluding conflict-of-law rules, unless mandatory consumer protections in your place of residence require otherwise.

Except where prohibited, you and Domaxus agree that courts located in Texas will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, and you consent to personal jurisdiction there. If you are a consumer entitled to bring claims in your home jurisdiction under mandatory law, that right is not waived where waiver is prohibited.

BEFORE FILING A CLAIM, YOU AGREE TO TRY TO RESOLVE THE DISPUTE INFORMALLY BY EMAILING info@domaxus.com WITH “DISPUTE NOTICE” IN THE SUBJECT LINE AND A BRIEF DESCRIPTION OF THE ISSUE. If we cannot resolve it within thirty (30) days, either party may proceed with formal dispute resolution as allowed by law.

TO THE EXTENT PERMITTED BY LAW, YOU AND DOMAXUS WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION. Claims must be brought only in an individual capacity. If this waiver is found unenforceable for a particular claim, that claim must proceed in court and not on a class basis under these Terms’ dispute process, to the extent required by law.

18. Compliance and Geographic Use

You are responsible for complying with applicable laws in your jurisdiction. The Services are controlled from the United States and may not be appropriate or available elsewhere. If you access the Services from outside the United States, you do so at your own initiative and are responsible for local compliance.

19. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy and any feature-specific terms presented at purchase, are the entire agreement between you and Domaxus regarding the Services and supersede prior agreements on that subject.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
  • No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, corporate reorganization, or sale of assets.
  • Force majeure. We are not liable for delays or failures due to events beyond our reasonable control.
  • Notices. We may provide notices via the Services, email, or posting to the site. You may contact us at info@domaxus.com.
  • Headings. Headings are for convenience only and do not affect interpretation.
  • No third-party beneficiaries. These Terms do not create third-party beneficiary rights, except as expressly stated for indemnified parties.
